Supreme court to hear dispute between Farmak, Darnitsa pharma companies over Corvalolum brand on Oct 9

The Supreme Court of Ukraine on October 9, 2018 is to hear a dispute between PJSC Farmak and PrJSC Darnitsa pharmaceutical firm over the right to the Corvalolum brand.

The press service of Farmak reported that the company hopes that the lawsuit will be heard by the Grand Chamber of the Supreme Court of Ukraine.

As reported, the appeal chamber of the Economic Development and Trade Ministry of Ukraine on June 20, 2017 declared the Corvalolum trademark used by PJSC Farmak as well-known one.

Darnitsa pharmaceutical firm appealed to the business court of Kyiv seeking to declare the decision of the ministry unlawful. The court of lower instance dismissed the Darnitsa's lawsuit, while the business court of appeals in Kyiv upheld the counterclaim of Darnitsa pharmaceutical firm.

Farmak filed a counterclaim to the Supreme Court of Ukraine. Farmak declares that Corvalolum has been produced since 1960 and belongs to the company, as the medication was created in 1960 by Lomonosov Kyiv Chemical-Pharmaceutical Plant, and Farmak is the legal successor of the plant.
