Court turns down Tymoshenko's lawsuit against penitentiary service

The District Administrative Court of Kyiv on Tuesday decided not to satisfy an appeal of Ukrainian ex-Premier Yulia Tymoshenko against the actions of the State Penitentiary Service of Ukraine in full.

As the press service of the State Penitentiary Service reported, Tymoshenko, convicted on May 21, submitted a lawsuit at Kyiv's District Administrative Court against the unlawfulness of the State Penitentiary Service of Ukraine with regard to her rights as a prisoner to phone calls, releasing confidential information about the state of her health, installing Web cameras in Ukrzaliznytsia's Central Clinical Hospital No. 5 in Kharkiv, and conducting video surveillance of her, as well as the appointment of male guards.

The penitentiary service stressed that the court declared accusations of the former premier unreasonable and ones that do not correspond to reality.

In particular, the press service said that "the court affirmed that video surveillance is being conducted legally at the premises of the prisoner. Such practice corresponds to the demands of international and European law and is aimed at ensuring the safety of people held in custody.

The service also reported that it proved in court the fact that it had released no confidential data about Tymoshenko, and had not violated her rights.

On October 11, 2011, Pechersky District Court in Kyiv sentenced Tymoshenko to seven years in prison for overstepping her authority when signing the 2009 gas contracts with Russia. She has served her sentence in Kachanivska Penal Colony in Kharkiv since late December 2011. Currently, she is undergoing a course of treatment at Kharkiv-based Central Clinical Hospital No. 5.
