Ukrzaliznytsia's accusation of blocking tender to buy fuel groundless

A statement of public joint-stock company Ukrzaliznytsia regarding a failure of a tender to buy diesel fuel due to its blocking by the Antimonopoly Committee of Ukraine is untrue, the committee has said.

"The Antimonopoly Committee of Ukraine sticks only to Ukrainian law when it fulfills the functions of the competition agency. The permanent panel that considers claims on violation of public procurement laws discusses only those claims that were submitted to the panel in line with the requirements of the law on public procurement," the committee said.

The committee said that on February 29, 2015, the panel accepted the claim of OKKO-Business Contract LLC about violation of public procurement law by the Center for Provision of Production of Ukrzaliznytsia when it was buying diesel fuel (five lots).

On March 1, 2016, the panel accepted the claim of Element Nafta LLC regarding the fact that e Center for Provision of Production of Ukrzaliznytsia violates public procurement law when it was buying diesel fuel under lot three.

The committee said that the panel requires materials and explanations from the company that ordered the purchase of diesel fuel to make the unbiased decision. The panel sent requests to the company and the materials (around 1,000 pages) were received only in the afternoon on March 3.

Chair of the permanent panel that considers claims on violation of public procurement law Andriy Vovk said that the committee will try to consider the claims as soon as possible, although the decision is to have proofs.
